An all-new, industry-first document that serves as the Agreement between the Owner and Design-Builder for “progressive” design-build. Under “progressive” design-build, the Owner typically retains the Design-Builder based largely on qualifications and approach because the project is either not yet well-defined or the extent of the conceptual documents is not yet far advanced. The parties agree on the price of the final design and construction when the project definition is sufficiently far advanced, to the mutual satisfaction of the parties. Progressive design-build is a type of project delivery that is becoming increasingly popular. EJCDC D-512 is a larger, more-complex Agreement than either EJCDC D-520 and D-525, and properly reflects the staged approach taken in progressive design-build to defining the project’s scope and its associated costs.
