Description
We have taken both common themes as well as current crazes in owner drafted contracts, and spelled them out in our power point. The discussion will center on two different issues: What type of threat do they pose to the design firm, and are there workarounds, or things the designer can do to mitigate or possibly even avoid the risks of bad contracts.
Educational Objectives
- Using actual contracts presented for review to us, we will identify common contract terms and conditions which create potential risks for the design firm
- Discuss the problematic aspects of the wording of clauses or the clauses themselves
- Describe how to avoid, retain and mitigate the risks associated with bad contract language.
- Recommend how to address the client comment, “I have five designers who will sign this contract as drafted.
