Description
In January 2023, EPA and the U.S. Army Corps of Engineers (USACE) published a final rule revising the definition of “waters of the United States” (aka WOTUS) under the Clean Water Act. In May 2023, the U.S. Supreme Court ruled on Sackett v EPA which invalidated certain aspects of the WOTUS definition in the January final rule. On August 29, 2023, EPA and USACE amended the 2023 definition of WOTUS. So the world make sense now, again, right? Well, not perfectly (yet?). This presentation/discussion will walk through the current state of WOTUS, the changes, the unknowns, and pontifications of some ideas for the coming months and year.
